JUSTICE PRABHAT KUMAR JHA ORAL ORDER 13-02-2015 Heard learned counsel for the petitioner, State as well as the informant.

The petitioner apprehends his arrest in Madhuban P.S. Case No. 90 of 2014, registered for the offences punishable under Section 376 and other Sections of the Indian Penal Code. The victim made allegation that the petitioner on the pretext of marrying with her established physical relationship and when she became pregnant she was forcibly aborted. Later on, the petitioner refused to marry with her.

Considering the facts aforesaid I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected.

No.6109 of 2015 (2) dt.13-02-2015 2/2 However, the petitioner, if so advised, may surrender before the court below within four weeks from the date of receipt/production of a copy of this order and pray for regular bail and his prayer shall be considered on its own merit without being prejudiced by this order.
