JUSTICE MOHIT KUMAR SHAH ORAL ORDER 06-09-2022 In pursuance to the earlier order of this Court dated 16.08.2022, a counter affidavit has been filed by District Magistrate, Sheikhpura, wherein, it has been stated that the respondent- State has filed a Title Suit bearing Title Suit no. 163 of 2022 before the learned Civil Court, Sheikhpura for the purposes of declaring the land in question as a public land, hence, it is submitted by the Ld. Counsel for the respondent- State that the encroachment case in question i.e. Encroachment case no. 10 of 2003-04 cannot proceed till a declaration is made in favour of the respondent- State by the learned Civil court in the pending Title Suit.
