The petitioner apprehends his arrest in a criminal prosecution registered under Sections 365, 379 and some other allied offences under the Indian Penal Code.

Taking into consideration the fact the petitioner is specifically named in the first Information Report vide Annexurer1 as an accused and he is alleged to have participated in the kidnapping of the victim boy and also taking into consideration the fact that the alleged victim is still traceless and has not been recovered, as noticed by the learned Sessions Court in the impugned order and further taking into consideration the fact that the petitioner is absconding for more than seven years as the present criminal prosecution was instituted in the year 2008, this Court is not inclined to accede to the prayer made on behalf of the petitioner for grant of anticipatory bail. Accordingly, his prayer for anticipatory bail in connection with Ballia P.S.Case 227 of 2008 pending in the court of the learned Chief Judicial Magistrate, Begusarai is rejected.

However, if the petitioner surrenders in the court

No.13514 of 2016 (2) dt.20-04-2016 2/2 below within a period of four weeks from today and applies for regular bail, then the same shall be considered on its own merits without being prejudiced by the rejection of his prayer for grant of anticipatory bail by the present order.
