2. The petitioner has prayed for bail in connection with Tariyani P.S. Case No.79 of 2026 registered for the offence punishable under Sections 191(2), 190, 329(3), 126(2), 115(2), 109(1), 118(2), 303(2), 352 & 351(2) of the BNS.

3. The case of the prosecution, in short, is that the petitioner along with other named 20 persons arrived starting assaulting the informant. It is specifically alleged that petitioner and one Dilip Thakur assaulted the informant with iron rod on the head indiscriminately and on mouth and nose. It is further alleged that after this, accused persons started assaulting the informant.

4. Learned counsel appearing on behalf of the petitioner has submitted that nature of allegation is general and omnibus. There is also a counter version of this case which is annexed at page 24 of the brief as Tariyani P.S. Case No.78 of

Patna High Court CR. MISC. No.37208 of 2026(2) dt.16-06-2026 2/2 2026 which is prior to this case. Learned counsel for the petitioner has submitted that from perusal of the injury report also it transpires that only one injury on the head is found to be grievous. It has further been submitted that it was free-fight between the parties and both sides have received injuries. It has further been submitted that the petitioner is in judicial custody since 16.03.2026.

5. The application for bail is opposed by learned APP for the State. It has been submitted that the petitioner is having criminal antecedent of one case.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the court of learned C.J.M., Sheohar in connection with Tariyani P.S. Case No.79 of 2026.
