JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 29-06-2015 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. The petitioners apprehend their arrest in connection with Dumraon P.S. Case No. 33 of 2015 registered under sections 302, 201/34 of the Indian Penal Code. Petitioner no. 1 happens to be sautan of the deceased whereas petitioner no. 2 is son of petitioner no. 1. Accusation against the petitioners is that they administered poison to the deceased but in course of investigation some witnesses stated that the deceased died of her natural death and on the alleged date of occurrence when the deceased did not open the door of her room, they broke open the window and entered into
Patna High Court Cr.Misc. No.14465 of 2015 (3) dt.29-06-2015 the room where the deceased was found lying dead. The I.O. visited the place of occurrence and it would appear from paragraph 6 of the case diary that one window of the room of the deceased was found broken.
Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that the petitioners, in the event of arrest/surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Buxar in connection with Dumraon P.S. Case No. 33 of 2015 subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
