JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 20-07-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. This application for grant of anticipatory bail arises out of Piprahi P.S. Case No.80 of 2015, disclosing offences under Sections 302 and 201 of the Indian Penal Code. Learned counsel for the petitioner has submitted that the F.I.R. was registered against unknown by the father of the deceased. Two days after lodging of the F.I.R., the informant has taken the name of the petitioner and others responsible for commission of the offence. He has submitted that the informant would have at the time of lodging of the F.I.R. itself taken the name of the petitioner, had the petitioner been involved. However, considering the gravity of the offence and

Patna High Court Cr.Misc. No.14557 of 2016 (4) dt.20-07-2016 2/2 the fact that the petitioner's custodial interrogation may be needed, I am not inclined to grant the privilege of bail to the petitioner. This application is, accordingly, rejected.

The petitioner is directed to surrender before the court below within four weeks from today and seek regular bail, if so advised. If he does so, his application for regular bail shall be considered on its own merit, without being prejudiced by rejection of present application for grant of anticipatory bail.
