The petitioner seeks bail in Sessions Trial No.665 of 2016/ CIS No.802 of 2016 arising out of Shastrinagar P.S. case No.169 of 2016 registered under Sections 341, 342, 323, 326, 307, 498A/34 of the Indian Penal Code, pending in the court of 3rd Additional Sessions Judge, Patna and subsequently added Sections 302, 304(B) of Indian Penal Code.

The earlier bail application of the petitioner was rejected vide Annexure 1 to the present application taking into account that the petitioner happens to be the husband of the deceased. F.I.R. is dying declaration. The petitioner is also alleged to have participated in the alleged occurrence. A report was called for from the court below

Patna High Court CR. MISC. No.42113 of 2019(3) dt.11-09-2019 2/2 regarding the stage of trial. It has been reported that out of thirteen prosecution witnesses three prosecution witnesses have already been examined and the trial is expected to be concluded within a period of six to eight months.

Considering the nature of accusation and the stage of the trial, I am not inclined to grant bail to the petitioner. The same is rejected.

The Trial Court is directed to take all necessary steps to conclude the trial preferably within a period of six to eight months from the date of receipt/production of a copy of this order.
