The petitioner apprehends his arrest in Complaint Case No. 795 of 2015 registered for the offences punishable under Sections 420, 34 and 120B of the Indian Penal Code. Allegation against the petitioner is that the petitioner and others constantly induced the complainant to purchase the land of Md. Hakim and Md. Nasim situated at Village Islamganj, P.S. Chandauti, District Gaya. The complainant purchased the same land on consideration of Rs. 1,21,000/- in the name of his wife but later on he was not allowed to construct boundary wall over the land.

It is submitted that the petitioner neither received any

Patna High Court Cr.Misc. No.16211 of 2016 (2) dt.06-05-2016 2/2 consideration amount nor induced the complainant to purchase the land. The co-accused Md. Kalim and Md. Nasim have already been granted bail vide orders passed in A.B.P. No. 549 of 2016 on 17.02.2016.

Considering the facts aforesaid, the petitioner above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gaya in Complaint Case No. 795 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
