Petitioners being brother and brother's wife of the husband of the victim are apprehending their arrest in a case registered for the offences punishable under Sections 304B, 328, 120B/34 of the I.P.C.
Accusation is killing the daughter of the informant after two years of marriage for non-fulfilment of dowry demand.
It is submitted by learned counsel for the petitioners that postmortem does not reflect any external injury particularly the resisting injury and the viscera has been preserved.
Considering the thrust of accusation
Patna High Court Cr.Misc. No.9163 of 2015 (2) dt.04-03-2015 2/2 against the husband of the victim, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Katihar in connection with Katihar(M) P.S. Case No. 112 of 2014, G.R. No. 3080 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Dinesh Kumar Singh, J) Shageer/- U T
