2. The petitioner seeks bail in a case registered for the offence punishable under Sections 318(4), 319(2), 336(3), 338, 340(2) and 3(5) of the B.N.S. and Sections 3, 10 and 11 of the Bihar Public Examination (Prevention of Unfair Means) Act, 2024.

3. As per the prosecution case, the allegation against the petitioner is that she was caught with cheat papers in examination hall of Assistant Education Development Officer conducted by B.P.S.C.

4. Learned counsel for the petitioner submits that the present case has been filed under some provisions of the B.N.S. as also the provisions of Bihar Public Examination (Prevention of Unfair Means) Act 2024. The petitioner was a candidate in the AEDO Competitive Examination and it was

It is submitted that the seizure list in the present case indicates that no recovery was made from the possession of the petitioner and also there was violation of Section 103 and 105 of the BNSS. It is further submitted that the petitioner is a female, taking several competitive examinations and is in custody since 18.04.2026, with no criminal antecedent.

5. Learned APP for the State opposed the grant of bail on the basis of allegations made in the First Information Report.

Taking into consideration the facts and circumstances and also considering the fact that no recovery was made form the petitioner and also considering that she was candidate for the examination, let the above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, Biharsharif at Nalanda/concerned Court below in connection with Sohsarai P.S. Case No. 106 of 2026.
