Petitioner seeks bail in a case registered for the offence punishable under Section 392 of the Indian Penal Code. Learned counsel for the petitioner submits that F.I.R. is against unknown. Petitioner has been implicated in this case merely on suspicion. No Test Identification Parade has been held. There is no recovery of any incriminating article from possession of this petitioner. During course of investigation, co-accused, Praduman Kumar has been arrested by the Police, who disclosed the name of this petitioner in his confessional statement.
Petitioner is in custody since 25.09.2018.
Considering the facts aforesaid, let the petitioner,
Patna High Court CR. MISC. No.36635 of 2019(2) dt.18-06-2019 2/2 above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Kako Police Station Case No.221 of 2018, subject to condition that both the bailors shall be resident of within the territorial jurisdiction of the learned court below and the petitioner shall fully co-operate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
