The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 419, 420, 272, 273, 290, 482, 486, 487, 188/34 of the Indian Penal Code and 47A, 52, 53 of the Excise Act. It is alleged that on informant that petitioner being country made liquor licensee is also selling and serving foreign liquor, raid was laid and from the petitioner shop empty bottles of foreign liquor in huge quantity and beer bottles were seized, when no paper was produced regarding such possession.

It is submitted by the learned counsel for the petitioner that the petitioner had both the licenses for country made and foreign liquor and the same were produced before the

Patna High Court Cr.Misc. No.15679 of 2015 (2) dt.04-05-2015 raiding team which have been brought on record also as Annexure-2 series but maliciously the seizure was made. Considering the quantity of recovery of liquor, the petitioner being licensee and statement has been made in para3 of the petition that petitioner has no criminal antecedent, let the above named petitioner be released on bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran at Chapra in connection with Chapra Town P.S. Case No. 101 of 2014, subject to conditions as laid down under Section 438(2) of the Indian Penal Code. (Dinesh Kumar Singh, J) P.K./- U T
