The petitioner seeks bail in Fenhara P.S. Case No. 67 of 2021, registered for the offence punishable under Sections 307, 323 and other allied sections of the Indian Penal Code. As per the prosecution case, this petitioner assaulted by means of Farsa on the head of Indal Singh causing sharp cup injury on his head.

It is submitted on behalf of the petitioner that both parties are neighbours and dispute arose between the parties over the issue of pathway. There is case and counter case. Both sides sustained injury. Injury found on the person of Indal Singh is simple in nature vide Annexure-2. Petitioner claims clean antecedent and he is in custody since 02.06.2021. Considering the facts and circumstances of the case,
