2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 126(2), 308(5), 308(4) and 329(3) of the B.N.S.
3. The case of the prosecution, in short, is that the petitioner has threatened the informant for executing sale deed of his land failing which he will have to pay Rs. 50,00,000/- as rangdari.
4. Learned counsel appearing on behalf of the
Patna High Court CR. MISC. No.37603 of 2026(3) dt.23-06-2026 2/3 petitioner has submitted that petitioner is innocent and has committed no offence. He has been falsely implicated in this case. Learned counsel for the petitioner has submitted that from perusal of the F.I.R., it is clear that there is dispute regarding way between the parties. From perusal from the F.I.R., it is also clear that the occurrence is of 10.02.2026 whereas this case has been filed on 08.04.2026. It has further been submitted that the delay in filing of this case has not been explained by the informant and the delay is inordinate one. It has further been submitted that admittedly the petitioner is having criminal antecedents but as far as this case is concerned, there is only allegation of threatening and demanding rangdari. No randari has been paid. Petitioner is languishing in judicial custody since 10.04.2026.
5. Learned APP appearing for the State and learned counsel for the informant have vehemently opposed the application for bail. Learned counsel for the informant has submitted that the petitioner is having criminal antecedent of similar nature and that E.D. is also going to file case against the petitioner.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is
Patna High Court CR. MISC. No.37603 of 2026(3) dt.23-06-2026 3/3 inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Gopalganj, Bihar in connection with Gopalganj Nagar P.S. Case No. 369 of 2026 with the following conditions:- (i) The petitioner shall cooperate in trial and shall remain physically present on each and every fixed date in the learned trial Court.
(ii) The petitioner shall mark his weekly attendance at Nagar P.S.
(iii) Learned trial Court shall verify the criminal antecedent of the petitioner. According to the case of the petitioner, he is having criminal antecedent of nine cases. If he is having criminal antecedent of more than nine cases, his bail bond shall not be accepted by the learned trial Court. (Ashok Kumar Pandey, J) lata/- U T
