JUSTICE DINESH KUMAR SINGH ORAL ORDER 16-04-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 420, 120B, 467, 468,471/379,323,504/34 of the Indian Penal Code. It is alleged that co-accused Siya Ram Singh sold a piece of land of the informant to the petitioner through a registered sale deed to which co-accused Ramanand Rai and Uma Shankar Singh are identifier and witnesses.

It is submitted by learned counsel for the petitioner that the land in question was executed by the grand-father of the informant in favour of the vendor of the petitioner in 1975 and the petitioner purchased the same in 2014. Moreover, Title Suit No.854 of 2014 is also pending between the parties with regard to the land in question.

No.15851 of 2015 (2) dt.16-04-2015 2/2 Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Muzaffarpur (West) in connection with Paroo P.S. Case No.05 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
