The petitioner seeks bail in anticipation of her arrest in connection with Dhaka (Pachpakari O.P.) P. S. Case No. 203 of 2020, dated 05.06.2020, instituted for the offence under Section 7 of the E.C. Act.

The accusation against the petitioner is of having made attempts to sell the rice belonging to the PDS scheme unauthorizedly. This inference was made on the basis of recovery of 49 bags of rice from a tractor which was parked outside the PDS shop of the petitioner

Patna High Court CR. MISC. No.35429 of 2020(2) dt.25-03-2021 2/3 and in the godown of the petitioner, there was no corresponding raw materials meant for distribution to the beneficiaries of the PDS scheme.

The learned counsel for the petitioner has submitted that an absolutely false case has been lodged against her. She has a valid license under the PDS scheme. In fact, the godown of the petitioner was never inspected. The godown was full of the foodgrains for distribution to the beneficiaries.

Apart from this, it has been submitted that for this accusation, the license of the petitioner has already been suspended.

Considering the afore-stated facts, the petitioner, above-named, is directed to be released on bail, in the event of her arrest or surrender before the court below within a period of four weeks from the date of receipt / production of a copy of this order, on her furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to
