The petitioner seeks bail in anticipation of his arrest in connection with Bhagwanpur Hatt P.S. Case No. 30 of 2020, dated 09.02.2020, instituted for the offences under Sections 147, 148, 323, 324, 325, 307, 379, 354, 504 and

Patna High Court CR. MISC. No.35150 of 2020(2) dt.23-03-2021 2/3 506 of the Indian Penal Code.

It has been alleged in the F.I.R. that the petitioner and others came to the house of the informant, variously armed and started abusing him. On protest, one coaccused/Motilal Sah is said to have ordered the accused persons to assault the informant. One Hari Kishore Sah is said to have assaulted with lathi, which led to the fracture of one of the legs of the informant. The petitioner is alleged to have assaulted the nephew of the informant, as a result of which he is said to have received injury in his finger. There are other allegations also.

The learned counsel for the petitioner has submitted that the occurrence took place on 08.02.2020, but the report about the same was lodged a day later on 09.02.2020. It has further been submitted that the petitioner is a student who is preparing for competitive examination and has been made accused in this case only because of the dispute between the two families. There is a counter version of occurrence as well vide Bhagwanpur Hatt P.S. Case No. 32 of 2020.

No.35150 of 2020(2) dt.23-03-2021 3/3 Considering the nature of accusation against the petitioner and his being a student who is preparing for competitive examination, he, in the event of his arrest or surrender before the learned Court below within a period of eight weeks, is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Sri A.K. Tripathi, Siwan in connection with Bhagwanpur Hatt P.S. Case No. 30 of 2020, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
