Learned counsel for the petitioner submits that old case i.e. Case No.3 of 1998-99 remained pending but the Sub Divisional Officer Kahalgaon has created a new file, in view of the order passed by this Court passed a reasoned order and rejected the case of the petitioner. He further submits that subject matter of earlier case is same to the new case.
In this view of the matter, this application does not
Patna High Court MJC No.742 of 2015 (3) dt.16-09-2015 survive and accordingly the same is dismissed. It will be treated that earlier case has merged with the present case. However, petitioner, if so advised, will be at liberty to challenge the order passed by the Sub Divisional Officer, Kahalgaon.
