The petitioner apprehends his arrest in a case registered for the offence under Sections 409 / 420 of the Indian Penal Code.

Petitioner is alleged to have misappropriated an amount of Rs. 44,209/-, which was collected as revenue by the petitioner.

After some argument, learned counsel for the petitioner submits that petitioner is ready to refund the alleged amount i.e. Rs. 44,209/- (Rupees forty four thousand two hundred nine only) in installment. In the light of above submission, he makes a prayer for grant of anticipatory bail to the petitioner.

Considering the aforesaid submission made on behalf of petitioner as well as facts and circumstances of the case, let

No.38337 of 2022(3) dt.29-11-2022 2/2 the above named petitioner, in the event of his arrest/surrender before the court below within a period of thirty days from the date of receipt/production of copy of this order, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Araria in connection with Raniganj P.S. Case No. 51 of 2016, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure with further condition that the petitioner shall refund Rs. 11,209/- (Rupees eleven thousand two hundred nine only) through Bank Draft to the informant / Circle Officer, Raniganj (Siwan) at the time of furnishing bail-bond and rest amount i.e. Rs.

33,000/- (Rupees thirty three thousand only) shall be refunded in three installment of Rs. 11,000/- (Rupees eleven thousand only) each within a period of one year from the date of furnishing bail-bond through Bank Draft to the informant / Circle Officer, Raniganj (Siwan), failing which, the learned court below would be at liberty to cancel the bail-bond. The said deposit shall be subject to the final outcome of the case.
