The petitioner seeks bail in connection with Bihariganj P.S. Case No. 319 of 2019 instituted for the offences under Sections 392 and 395 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner is in custody since 22.12.2020, charge-sheet has been submitted in the case and has one case against him which inadvertently could not be recorded at paragraph '3' of the bail application.

Learned counsel for the petitioner submits that allegation is of looting of Rs. 4,85,000/- from the informant by two unknown criminals.

No.47183 of 2021(2) dt.18-01-2022 2/2 Learned counsel for the petitioner submits that the name of the petitioner transpired in the confessional statement of Mukesh Kumar Sharma who is a co-accused in the present case. Learned counsel submits that confessional statement does not have any evidentiary value in the eyes of law.

Learned A.P.P. for the State vehemently opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody since 22.12.2020, is not named in the F.I.R., his name transpired in the confessional statement of co-accused and charge-sheet has been submitted in the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Udakishunganj in connection with Bihariganj P.S. Case No. 319 of 2019 with a condition that one of the bailors shall be the father of the petitioner. Learned counsel for the petitioner undertakes to rectify the pleadings made at paragraph '3' of the bail application within a week after opening of the Court in physical mode.
