====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 21-09-2023 Heard learned counsel for the petitioners and the State.
2. Petitioners apprehend arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 324, 325, 307, 379, 504 and 506 of the Indian Penal Code.
3. It is alleged that on 01.02.2023, at about 8:20 PM, when the informant and his brother were in the coaching center, all the F.I.R. named accused persons including these petitioners along with 20 unknown persons entered there by breaking the
Patna High Court CR. MISC. No.39894 of 2023(3) dt.21-09-2023 2/2 door and on the order of landlord co-accused Ajit Ray, all the accused persons brutally assaulted the informant and his brother.

Learned counsel for the petitioners submits that specific accusation of assault is against co-accused Manoj Barnwal who is alleged to have assaulted the informant on his head with the help of a Saif. There is general and omnibus allegation of assault against these petitioners. Petitioners have got clean antecedent.

Considering the nature of allegation and clean antecedent, this anticipatory bail is allowed and it is ordered that let the above named petitioners in the event of their arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Jamui in connection with Chakai P. S. Case No. 39 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
