This application for regular bail arises out of Panapur P.S. Case No. 49 of 2020, disclosing offence punishable under Sections 30/30(a)/38/41 of the Bihar Prohibition and Excise Act. On the allegation of recovery of 25 litres of countrymade liquor from a place in the petitioner's occupation, he is in custody since 04.07.2020. From paragraph-3 of the application, it appears that the petitioner has criminal antecedent, inasmuch as, he has been implicated in another case registered as Panapur P.S. Case No. 82 of 2020.

However, considering the quantity of liquor, said to have been recovered from the petitioner's possession, as noted above, and that he is in custody since 04.07.2020, this

Let the petitioner, above-named, be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand), with two sureties of the like amount, each to the satisfaction of learned 2nd Additional Sessions Judge/ Special Judge, Excise, Saran, Chapra, in Panapur P.S. Case No. 49 of 2020.

It is, however, indicated that any subsequent involvement of the petitioner in similar offence shall be a ground for cancellation of petitioner's bail granted by virtue of the present order.
