Petitioners apprehend their arrest in a case registered for the offence punishable under Sections 323, 341, 379, 498(A), 504, 506 of the Indian Penal Code and Section 4 of Dowry Prohibition Act.

As per the prosecution case, petitioners along with other family members committed torture on the informant due to non-fulfilment of dowry demand.

Petitioner no. 1 is mother-in-law and the petitioner

Patna High Court CR. MISC. No.39109 of 2023(2) dt.07-07-2023 2/2 no.2 is the father-in-law of informant.

Learned counsel for the petitioners submits that the petitioners are innocent and have falsely been implicated in this case. It is further submitted that the petitioners are separate in mess and property and have got no concern with the alleged occurrence. The specific allegation of committing torture due to non-fulfillment of dowry is leveled against the husband of the informant. Petitioners claim clean antecedent. Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioners, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Jehanabad in connection with Complaint Case No. 77 of 2021, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
