The petitioners are apprehending their arrest in connection with Baniyapur P.S. Case No.31 of 2016 for the offences instituted under Sections 341, 323 and 307/34 of the Indian Penal Code.

The prosecution case, in brief, is that on 29.1.2016 at 2 P.M., the informant was erecting wall on his land when his agnates came and damaged the wall. On protest, they assaulted him with brick, stone, Lathi, Danda and Daab causing injury on his hand.

It is submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. It is a case and

Patna High Court Cr.Misc. No.15575 of 2016 (2) dt.03-05-2016 2/2 counter case between the parties. Injury sustained on the petitioners' side has not been explained by the prosecution. On behalf of the State, it is submitted that the petitioners are not named in the F.I.R.

Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of arrest or surrender in the court below within a period of six weeks, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand only) each with two sureties of the like amount each to the satisfaction of Sri R.K. Yadav, J.M., Saran at Chapra, in connection with Baniyapur P.S. Case No.31 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
