2. The petitioners seek regular bail in a case registered for the offence under Sections 191(2), 191(3), 190, 329(3), 126(2), 115(2), 118(1)(2), 117(2), 103(1), 74, 352, 351(3) of the Bharatiya Nyaya Sanhita, 2023.
3. Though the allegation against the petitioners is of committing murder but it has come during investigation that because of partition there was fight between both side and in that fight, the deceased sustained injury. The accused side has also sustained injury including the petitioner no. 2.
4. The petitioners in custody since 17.11.2024 and
Patna High Court CR. MISC. No.37030 of 2025(2) dt.18-06-2025 2/2 claim clean antecedents.
5. Considering the facts and circumstances of the case, this application for regular bail is allowed.
6. Accordingly, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Principal District and Sessions Judge, Aurangabad/concerned Court below in connection with Salaiya P.S. Case No. 90 of 2024 subject to the condition that the petitioners will cooperate in the trial.
