Heard learned counsels for the petitioners and the State.
The petitioner no. 2 is apprehending arrest in a case registered for the offences punishable under Sections 341,323,324 and 307/34 of the Indian Penal Code. It is alleged that co accused Mahesh Ram assaulted with Farsa on the head of the informant and co accused Manoj Ram assaulted with Garasa when the aunt of the informant came to rescue then she was also assaulted by petitioner no. 2 Indal Ram with iron rod causing injury on nose when others also assaulted the
Patna High Court Cr.Misc. No.10625 of 2015 (3) dt.28-04-2015 2/3 informant and his aunt.
It is submitted by the learned counsel for the petitioners that specific accusation of assault is not against petitioner no. 1 whereas the impugned order suggests that only pain on shoulder was complained by the aunt of the informant. Though injury report has not been brought on record but it is submitted that there is no injury on the nose of aunt of the informant. Statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent.
Considering the aforesaid facts, let the above named petitioner no. 2 be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Sitamarhi in connection with Dumra P.S. Case No. 132 of 2013 subject to the conditions as laid down under Section 438(2) Cr.P.C.
The bail bond of petitioner no. 2 will be accepted by the learned court below on verification of the fact that there is no injury on the nose of the aunt of the
Patna High Court Cr.Misc. No.10625 of 2015 (3) dt.28-04-2015 3/3 informant.
