Earlier vide order dated 17.03.2023 passed in Cr. Misc. No.1766 of 2023, the bail application of the petitioner was withdrawn by the learned counsel for the petitioner with liberty to file a fresh anticipatory bail application within six weeks from 17.03.2023.

It is submitted by the learned counsel for the petitioner that the police, after investigation filed final form against the petitioner (Annexure-3) but till date the learned Court below has not taken cognizance against the petitioner.

Having regards to the facts and circumstances of the case, as the learned counsel for the petitioner had himself withdrawn the anticipatory bail application of the petitioner and in view of the recent decision of the Supreme Court in the case of G.R. Ananda

Patna High Court CR. MISC. No.38054 of 2023(3) dt.26-07-2023 2/2 Babu vs. State of Tamil Nadu and Another reported in 2021 SCC Online SC 176, this second anticipatory bail application is not maintainable.

Accordingly, this anticipatory bail application is dismissed as not maintainable.
