JUSTICE DINESH KUMAR SINGH ORAL ORDER 08-04-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341,323,324,307 and 504/34 of the Indian Penal Code.

The prosecution case is that the accused persons including the petitioner surrounded the informant when co accused Upendra Singh alias Lalbabu Singh alias Kharaha Gurubhai assaulted with Dab causing injury on the right side of the back of head of the informant. He repeated causing injury on his left hand when the informant fell down other accused persons including the petitioner assaulted the informant with fists and slaps. It is submitted by the learned counsel for the petitioner that though the informant has received three injuries but the injury on the occipital region has been found caused by hard and blunt

It is further submitted that specific accusation is against co accused Upendra Singh and there is counter version of the occurrence and the petitioner side has also received injury. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Saran at Chapra in connection with Revelganj P.S. Case No.222 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
