The petitioner apprehends his arrest in Complaint Case No. 462(C)/2013 registered under Section 498(A) of the Indian Penal Code and Sections 3/4 of the Dowry Prohibition Act. The complainant, wife of the petitioner, made allegation that the petitioner demanded additional dowry and her husband always subjected her to physical and mental torture. Learned counsel for the petitioner submits that much prior to the filing of the present complaint case on 24.04.2013, the petitioner filed a matrimonial suit in the Family Court, Gurgaon on 19.03.2013. Considering the fact that before filing of this complaint petition the petitioner filed a divorce case against the complainant, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, Patna City, Patna in Complaint Case No. 462(C)/2013, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
