The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 341, 447, 323, 324, 307, 427, 379, 504, 34 of the Indian Penal Code. It is alleged that protest was made while accused person was damaging house of the informant when the petitioner Gopal Sah assaulted the informant by 'farsa' and fit and when daughter-in-law of the informant namely Beena Devi came to rescue she was also assaulted by Gopal Sah whereas Jai Prakash Sah assaulted the informant by kick and fat, when son of the informant came to rescue he was also assaulted and petitioner no. 1 committed theft of Rs.17,000/-.

Patna High Court Cr.Misc. No.14363 of 2015 (2) dt.07-04-2015 2/2 It is submitted by learned counsel for the petitioners that injury of the informant is found simple in nature. There is counter version of the occurrence also. A statement has been made in para 3 of the petition that the petitioners have no criminal antecedent.

Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Motihari (East Champaran) in connection with Harsidhi P.S. Case No.390 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
