The petitioners apprehend their arrest in Sangrampur P.S. Case No. 121 of 2013, registered for the offences punishable under Section 307 and other Sections of the Indian Penal Code. The informant alleged that Rajesh Raut his son asked for tobacco from Virandi Raut, but some verbal altercation took place. Thereafter the petitioners are alleged to have assaulted Rajesh Raut.

Learned counsel for the petitioner submits that there is counter version. Rajesh Raut got one incised wound on head and another bruise of left arm. Both the injuries are simple. Omnibus and general allegation of assault is made.

No.5980 of 2015 (2) dt.12-02-2015 2/2 Considering the facts aforesaid and the fact that Rajesh Raut has got simple injuries and no specific allegation of assault is made against the petitioners, they, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Sadar Motihari in connection with Sangrampur P.S. Case No. 121 of 2013, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
