The petitioner apprehends his arrest in Complaint Case No. 1183 of 2013, registered for the offences punishable under Section 498(A) of the Indian Penal Code. The wife made allegation of demand of dowry and torture.
Learned counsel for the petitioner submits that the petitioner is ready to keep his wife on any undertaking. On the other hand, learned counsel for the complainant submits that the complainant is also ready to live with her husband provided that her husband gives an undertaking that he would not have relation with his Bhabhi.
Patna High Court Cr.Misc. No.32832 of 2014 (2) dt.04-02-2015 On considerations of the facts, the petitioner, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Learned Sub-Divisional Judicial Magistrate, Sitamarhi in connection with Complaint Case No. 1183 of 2013, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and also that the petitioner shall file an affidavit stating that he would keep his wife properly.
