JUSTICE DINESH KUMAR SINGH ORAL ORDER 26-02-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341,323,324 and 307/34 of the Indian Penal Code and section 27 of the Arms Act. It is alleged that co accused Jai Prakash yadav and Bhim Yadav were quarrelling when the informant went to pacify then this petitioner caused fire arm injury on the left knee of the informant. Similar was the statement of the informant when his subsequent statement was recorded.

It is submitted by the learned counsel for the petitioner that in 164 Cr.P.C. statement, the informant has specifically stated that the injury was caused to the informant by Jai Prakash Yadav. Statement has been made in paragraph 3 of the petition that the

Patna High Court Cr.Misc. No.7709 of 2015 (2) dt.26-02-2015 2/2 petitioner has no criminal antecedent.

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Birpur in connection with Partapganj P.S. Case No.62 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
