JUSTICE DINESH KUMAR SINGH ORAL ORDER 26-03-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 7 and 9 of the Essential Commodities Act.

It is alleged that the petitioner being a fair price shopkeeper committed irregularities in distribution of the food-grains supplied under different government schemes. The stock register was not found in proper order and the petitioner used to charge more than prescribed price for the food-grains.

A statement has been made in paragraph 19 of the petition that no inspection of the shop was made and only on the report of the Block Supply Officer, the F.I.R. was registered and pursuant to the same his license was cancelled. Moreover not a single complaint was made against him by the consumers. A statement has been made in para 3 of the petition that the petitioners have no criminal antecedent.

No.12721 of 2015 (2) dt.26-03-2015 2/2 Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gaya in connection with Konch P.S. Case No.108 of 2014 , subject to the conditions as laid down under Section 438(2) Cr.P.C.
