2. The petitioner has preferred this application for grant of regular bail in connection with S.T. P.S. Case No. 10/2016 arising out of Kajra P.S. Case No. 36 of 2013 dated 03.08.1013 registered for the offences punishable u/ss 147, 148, 149, 364, 436, 120B of the IPC and sections 10, 13, 16 of the U.A.P. Act.

3. As per the prosecution case, 10 unknown miscreants are alleged to have kidnapped the driver and the Munsi of the informant on the point of pistol and set his bolero vehicle on fire.

4. Learned counsel for the petitioner has submitted

Patna High Court CR. MISC. No.42484 of 2025(3) dt.25-08-2025 2/3 that the petitioner is innocent and has falsely been implicated in this case. The petitioner is not named in the FIR. The name of the petitioner has sprung up in the confessional statement of the co-accused Karelal Koda, Rajesh Modi and Virendra Koda. Nothing has been recovered from the conscious possession of the petitioner. Similarly situated co-accused has already been granted bail by the co-ordinate bench of this court vide order dated 17.02.2014 passed in Cr. Misc. No. 49555 of 2013. The petitioner has five criminal antecedents as stated in para 3 of the bail petition. The petitioner is in custody since 28.11.2024.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Lakhisarai in connection with S.T. P.S. Case No. 10/2016 arising out of Kajra P.S. Case No. 36 of 2013, with a condition/s:- (i). The petitioner is directed to remain physically present before the learned Court below on each and every date,

Patna High Court CR. MISC. No.42484 of 2025(3) dt.25-08-2025 3/3 failing which on two consecutive dates without reasonable cause, the bail bond of the petitioner is liable to be cancelled. (ii). If the petitioner is found involved in similar nature of offence in future, the prosecution will be at liberty to move for cancellation of his bail bond.
