The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 307, 323, 341, 324, 506, 504 of the Indian Penal Code. It is alleged that the petitioners being the agnates of the informant entered into the house, assaulted the informant with farsha and garasa and when the daughter and son-in-law of the informant came to rescue, they were also assaulted.

It is submitted by the learned counsel for the petitioners that accusation is omnibus and general, though the incised injury has been received by the informant and his family members. The opinion has been

Patna High Court Cr.Misc. No.14382 of 2015 (2) dt.07-04-2015 reserved, but apparently the injury appears to be simple in nature. There is counter version of the occurrence also. Statement has been made in para-3 of the petition that petitioners have no criminal antecedent.

Considering the aforesaid facts, let the above named petitioner be released on bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran at Chapra in connection with Dighwara P.S. Case No. 198 of 2014, subject to conditions as laid down under Section 438(2) of the Indian Penal Code.
