JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 16-01-2017 Heard learned Counsel for the petitioner and learned Additional Public Prosecutor representing the State. The petitioner is the wife of accused Jitendra Kumar. She seeks transfer of Jehanabad Police Station Case No. 271 of 2015, registered for the offences punishable under Sections 323/341/307/379/498A/34 of the Indian Penal Code, from Sessions Division, Jehanabad, to Sessions Division, Gaya.

On the basis of what has been narrated in the present application seeking transfer, no case for transfer of the case, under Section 407 of the Code of Criminal Procedure, 1973, is made out.

I have perused the report of the Superintendent of

Patna High Court Cr.Misc. No.18558 of 2016 (5) dt.16-01-2017 2/2 Police, Jehanabad, which indicates that the Superintendent of Police, Jehanabad, has assured all protection to be provided to the petitioner whenever required in course of the trial.

There is no merit in this application, which is accordingly dismissed.
