Mr.APP ====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 22-01-2021 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Chiksaura P.S. Case No. 106 of 2016 (S.T. No. 182 of 2017) for the offence under Sections 147, 148, 149 and 302 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is in custody since 02.11.2016.

Earlier the prayer for grant of bail of the petitioner was rejected twice. While rejecting the prayer for grant of bail, the court below was directed to expedite the trial, but unfortunately the trial has not been concluded as yet. In the aforesaid circumstances, the court below (Additional Sessions Judge-III, Hilsa, Nalanda) is directed to expedite the trial and conclude the same positively within a

Patna High Court CR. MISC. No.35963 of 2020(2) dt.22-01-2021 2/2 period of four months from the date of receipt/production of a copy of this order, failing which the court below shall release the petitioner on bail on appropriate terms and condition and submit a report before the Registrar (Vigilance) of this Court for the failure in conclusion of the trial.
