====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 02-12-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State.
The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 406, 420, 467, 468, 471, and 34 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and the informant alleges that the named accused persons including the petitioner took Rs. 5,00,000/- on different dates from him on the pretext of providing service in the Railways and thereafter gave a forged and a fabricated joining letter of Group-D in Railway and the same was found forged and fabricated and when the informant demanded his money from the accused persons, they did not return, as such it is alleged that the petitioner committed forgery
Patna High Court CR. MISC. No.38030 of 2022(2) dt.02-12-2022 2/3 and cheating with the informant.
Learned counsel for the petitioner submits that petitioner is innocent and has been falsely implicated in the present case and if what has been alleged in the F.I.R is true, then the informant is equally liable for prosecution as he himself admits that he has given money to seek backdoor appointment in the Railway based on bribe.
Learned counsel for the petitioner next submits that police after investigation submitted Final Form but the learned Trial Court differing with the police report took cognizance of the offence in a mechanical manner. It is also submitted that coaccused Ajeet Kumar Singh has been granted anticipatory bail by order dated 27.09.2022 in Criminal Miscellaneous No. 19075 of 2022.
Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.
Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the
Patna High Court CR. MISC. No.38030 of 2022(2) dt.02-12-2022 3/3 satisfaction of the learned trial court where the case is pending/successor court in connection with Nawanagar P.S. Case No. 72 of 2020 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
