2. The petitioner apprehends his arrest in connection with Barauli P.S. Case No. 264 of 2017 (G.R. No.-4443 of 2017), registered for the offences punishable under Section 392 of IPC.
3. As per the prosecution case, the informant was driving a truck loaded with Fortune. On 13.11.2017, 4-5 unknown accused persons pointed gun at him and forcibly led him and his helper. They fed them 5-6 medicine tablets due to which they fell unconscious.
4. The learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The petitioner is a person of clean antecedent. It has further been submitted that co-accused Sanjay Bhushan Singh was arrested and he furnished a vivid description of the entire occurrence with the
Patna High Court CR. MISC. No.35492 of 2025(4) dt.20-11-2025 2/2 specific role played by the co-accused persons named in his confessional statement and he depicted no role of the petitioner in his confessional statement.
5. On the other hand, learned APP for the State has opposed the prayer for anticipatory bail.
6. Considering the above-mentioned facts and circumstances, let the petitioner, in the event of his arrest or surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-1st Class, Gopalganj in connection with Barauli P.S. Case No. 264 of 2017 (G.R. No.-4443 of 2017), subject to the conditions as laid down under Section 438(2) of the CrPC/482(2) of the BNSS, 2023.
