====================================================== CORAM: HONOURABLE MR. JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 17-08-2023 Heard learned counsel for the petitioner, informant and learned Additional Public Prosecutor for the State.

2. The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 448, 341, 384, 500, 506/34 of the Indian Penal Code and Section 67 of the IT Act.

3. Allegation against the petitioner is that he spread message with intention to defame the informant and his family members that illicit relationship with the informant's daughter and accused Tulla.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. He submits that the petitioner and informant are own gotia to each other, as such, daughter of the informant is the sister of

He submits that occurrence took place on 07.09.2022 but the FIR has been lodged on 11.09.2022 after delay of 4 days without explaining any reasonable cause of delay. He submits that there is no specific overt act against the petitioner. He further submits that petitioner has no criminal antecedent as stated in para-3 of this application.

5. Learned APP for the State and learned senior counsel for the informant opposing the prayer for bail submit that the petitioner defamed the family member of the informant.

6. Considering the nature of offence, I am not inclined to enlarge the petitioner on bail. Accordingly, his prayer for anticipatory bail is rejected in connection with Lakhisarai (Ramgarh O.P.) P.S. Case No. 736 of 2022. (Anjani Kumar Sharan, J) devendra/- U T
