JUSTICE PRABHAT KUMAR JHA ORAL ORDER 29-01-2018 Heard Sri S. S. Dwidevi, the learned senior counsel for the petitioner, and Sri Jitendra Kishore Verma, the learned counsel for the respondent.

The petitioner has filed this Civil Misc. Petition for quashing the order dated 25.04.2017 passed by Sub-Judge-I, Vaishali at Hajipur, as contained in Annexure-10, by which the learned Sub-Judge has stayed the advertisement of the defendant company/ petitioner and also prayed to quash the entire proceeding of Title Suit No. 425 of 2017.

The learned senior counsel for the petitioner submits that during the pendency of this case the plaintiff and the respondents have compromised the case and according to terms of compromise let the order dated 25.04.2017 be quashed and the plaint of Title Suit No. 425 of 2017 may also be rejected.

Patna High Court C.Misc. No.913 of 2017 (5) dt.29-01-2018 2/2 Mr. Jitendra Kishore Verma, the learned counsel for the respondent, also submitted that both the parties have compromised the case and agreed that the order, as contained in Annexure-10, be quashed and the Title Suit No. 425 of 2017 be also dismissed.

Accordingly, the order dated 25.04.2017 (Annexure10) is set aside and the Title Suit No. 425 of 2017 is also dismissed.

This Civil Misc. petition is disposed of on compromise, as aforesaid.
