The petitioner apprehends his arrest for the offences punishable under Section 498(A) of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act.
It is submitted on behalf of the petitioner that this is the second complaint case. The first complaint case bearing No.2788/09 was referred to the Police under Section 156(3) of the Cr.P.C. and, thereafter, Sadar P.S. Case No.116/09 was instituted. Thereafter, in the complaint case No.3348 of 2009 cognizance has been taken against the petitioner. In the first case, the petitioner

No.35787 of 2014 (2) dt.11-02-2015 2 / 2 was granted anticipatory bail by this Court vide Annexure 4 noticing that the victim herself was not willing to reside with him which was clear from the order dated 09.12.2010 Having regard to the facts and circumstances of the case, let the petitioner, namely Manoj Kumar Sah, be released on bail in the event of arrest/surrender before the court below within a period of six weeks from today in Complaint Case No. 3348/09 / Trial No.1298/13, on furnishing bail bond of Rs.10,000( Ten Thousand Rupees) with two sureties of the like amount each to the satisfaction of Sub-Divisional Judicial Magistrate, Hazipur (Vaishali) subject to the conditions as laid down under subsection(2) of Section 438 of the Code of Criminal Procedure.
