1. Heard learned counsel for the parties.

2. The petitioner has preferred this application for grant of regular bail in connection with Chanpatiya P.S. Case no.598 of 2023 registered under sections 307, 323, 341, 379, 504, 506 and 34 of the Indian Penal Code.

3. As per the prosecution case, the informant states that over a trivial dispute, the three accused persons including the petitioners herein started to abuse the informant. It is further stated that the petitioner gave a blow with an iron rod on his head leading to injuries.

4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the case. Even as per allegations in the FIR, a trivial dispute has been shown. The informant has sustained injuries in a manner other than what has

Patna High Court CR. MISC. No.40583 of 2024(3) dt.30-08-2024 2/2 been narrated in the FIR. In any case, the injuries have been found to be simple in nature and the petitioner has remained in custody since 15.4.2024. Chargesheet has been submitted in the case.

5. Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the allegations in the FIR, the injuries having been found to be simple in nature and chargesheet having been submitted in the case together with the petitioner having remained in custody for over 4 months since 15.4.2024, the Court directs the petitioner to be enlarged on bail in connection with Chanpatiya P.S. Case no.598 of 2023 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bettiah, District West Champaran.
