JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 22-01-2020 This application has been filed by the petitioner seeking restoration of Cr.W.J.C. No. 836 of 2019 which stood dismissed for want of prosecution vide order dated 13.05.2019. It is contended by learned counsel for the petitioner that on 13.05.2019, when the case was called out, the learned counsel for the petitioner was busy in arguing another case before another Bench of this Court. In that view of the matter, he could not track the Court proceeding, as a result of which, the

Patna High Court MJC No.2120 of 2019(3) dt.22-01-2020 2/2 case stood dismissed for want of prosecution. It is further contended that the default on the part of the counsel or the petitioner was neither intentional nor deliberate. Learned counsel for the State does not oppose the prayer for restoration of the application.
