The petitioner is apprehending his arrest in connection with Salkhua P.S.Case No.147 of 2018 registered for offences punishable under Sections 341, 323, 504, 302 of the Indian Penal Code and Sections 25(1-b)A, 26, 37B and 27 of the Arms Act.

As per FIR, there is allegation against this petitioner of firing causing injury on the leg of the son of the informant and there is allegation against one more accused of firing causing injury to the deceased also and later on the deceased succumbed to the injuries.

Submission of the learned counsel for the petitioner is that the postmortem report does not support the prosecution case. On the other hand the learned APP has opposed the prayer

Patna High Court CR. MISC. No.38526 of 2019(4) dt.19-12-2019 2/2 for bail in the light of allegation against the petitioner. Heard learned A.P.P. also.

Having heard both sides and in view of the above, this application is dismissed and the petitioner has to surrender before the learned court below and make prayer for regular bail. With the aforesaid direction, this application is dismissed.
