JUSTICE DINESH KUMAR SINGH ORAL ORDER 07-05-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Section 379 of the Indian Penal Code.

It is alleged that theft was committed by the petitioner in video mixing shop of the informant by taking key of the shop on 12.09.2013.

It is submitted by learned counsel for the petitioner that the accusation has been levelled since the petitioner was demanding the wages against the work done by him at the shop of the informant and the informant left the job prior to the occurrence. It is further submitted that for the occurrence of 12.09.2013, the FIR was registered on 15.09.2013 and there is no recovery from the petitioner. A statement has been made in

Patna High Court Cr.Misc. No.13536 of 2015 (2) dt.07-05-2015 2/2 paragraph 3 of the petition that the petitioner has no criminal antecedent.

Considering the delayed lodging of the case and the accusation is based on suspicion, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Munger in connection with Tarapur P.S. Case No.96 of 2013, subject to the conditions as laid down under Section 438(2) Cr.P.C. The bail bond of the petitioner will be accepted on filing of the affidavit by the petitioner before the learned court below to the effect that he will regularly co-operate in the investigation. Non-cooperation in the investigation by the petitioner will give liberty to the learned court below to cancel the bail bonds of the petitioner.
