JUSTICE ASHUTOSH KUMAR ORAL ORDER 21-12-2020 Heard Mr. Abhishek Kumar, learned counsel for the petitioner and the learned APP for the State. The petitioner seeks bail in connection with Excise Case No. 977 of 2019, which has been instituted for the offences under Sections 272, 273 and 34 of the Indian Penal Code and Sections 30(a), 38, 32 and 41(i) of the Bihar Prohibition and Excise (Amendment) Act, 2018. It appears from the First Information Report that huge quantity of liquor was recovered from a Mahindra pickup van. The petitioner and another are alleged to have run

It has been submitted on behalf of the petitioner that he was not arrested on the spot. He has been made accused in this case only because he has criminal antecedents.

In the present case, the petitioner has been remanded on 28.08.2020.

Regard being had to the facts afore-stated, the petitioner above-named is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 7th Addl. Sessions Judge-cumSpecial Judge, Excise, East Champaran, Motihari in connection with Excise Case No. 977 of 2019.
