JUSTICE RAVI RANJAN ORAL ORDER 25-05-2016 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 323, 406, 409, 420, 504 and 506 of the Indian Penal Code.

It is contended on behalf of the petitioner that the allegation, as set out in the FIR, that he visited the concerned post office on 3.11.2015 is false as documents are there to show that the informant came to the post office on 5.11.2015 and the money was already withdrawn from the post office situated in the district of Balia. Thus, it is contended that the petitioner has no role to play even if it is presumed that the money was withdrawn fraudulently from the concerned post office. It is contended that he

Having regard to the facts and circumstances of the case, let the petitioner, namely, Mukund Kumar Srivastava be released on bail in the event of his arrest/surrender before the court below within a period of six weeks from today in connection with Chapra Town P.S. Case No.33/2016, on furnishing bail bond of Rs.10,000 (Ten Thousand Rupees) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Chapra subject to the conditions as laid down under sub-section (2) of Section 438 of the Code of Criminal Procedure.
