The petitioners are in custody in connection with Surajgraha (Manikpur) P.S. Case No. 51 of 2019 for the offences under Sections 448, 354(B), 323, 307 (D), 354 (D)/34 of the Indian Penal Code.

Allegation against the petitioners is that they have entered the house of the informant and tried to outrage the modesty of the sister of informant and on protest, they assaulted the informant.

Learned counsel for the petitioners would submit that petitioners have no criminal antecedent and they are in custody

Patna High Court CR. MISC. No.35343 of 2019(2) dt.29-05-2019 2/2 since 08.03.2019. Learned counsel further submits that the petitioners and informant are co-villagers and there is a dispute with regard to construction of drainage.

Considering the fact that petitioners have no criminal antecedent and petitioners and informant are co-villagers, the Court is inclined to grant bail to the petitioners. Let the petitioners, named above, are directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Lakhisarai, in connection with Surajgraha (Muffasil) P.S. Case No.51 of 2019 subject to the condition that both the bailors should be the neighbours of the petitioners.
